These terms establish the ways and conditions through which you can use our website and purchase the services and/or products we offer. This website offers users a wide range of high quality cosmetic products, and users, by accessing or using the website for our service, or by purchasing any product, acknowledge that they have read, understood and accepted and are bound by these terms.

  1. TERMS AND CONDITIONS OF SALE

These general conditions of sale govern the sale of services and/or products offered by us through our website "acquadipanarea.com" to which users have accessed with fixed (PC) or mobile devices (SMARTPHONE, TABLET, etc...). We reserve the right to enter, at a later date, specific "service orders" for specific services offered by us, which, in case of conflict with these general conditions of sale, will prevail.

Before proceeding to use or purchase a service and/or good offered by us, we strongly encourage you to read and understand these terms and conditions. By making any purchase you fully accept these terms and conditions.

  1. OUR CONTRACT

Proposals of services and/or goods found on our website should be considered as proposals to 'purchase or offers to the public. If you wish to purchase a product and/or service offered by us all you have to do is select the products and/or services and add them to the "shopping cart". Once you have selected all the products and/or services that you intend to purchase you will be able, through the "buy" button, to proceed with the order; then, you will see a page summarizing the products and/or services that you have chosen and selected, their price and delivery options with their costs. You will have to choose the type of transportation, payment method and preferred delivery option. On that page there will be a " Place Order "or "Continue to PayPal"" button that you will have to click to place your order.

Said order will be considered, for all purposes, your contractual proposal of purchase addressed to Vision S.r.l. regarding the products and/or services requested and selected. Upon receipt of your order we will send you, automatically, a message of ("Order Received"). The ("Order Received") does not constitute acceptance of your proposed purchase. The contract will be concluded only when you have received a separate communication containing the date of shipment of the product and the expected date of delivery ("Order Completed"). In the event that your order is composed of multiple shipments you may receive multiple ("Completed Orders") separate ("Completed Orders"). You will only be charged when the products and/or services are, respectively, shipped or purchased. You may cancel your order before you have received the ("Completed Order") email. This is without prejudice to your right to cancel. By completing your purchase you also agree to receive electronic billing only. Said invoices and additional documents will be available to you in the "My Profile" or "My Account" section. Said invoices will be communicated to you, previously, with the notice of ("Order Completed"). Before proceeding with your purchase and completing your order, we encourage you to ensure that the information you provide to us, including shipping information, is correct and complete. The shipping address can always be changed before the "Order Complete" communication in the appropriate "My Profile" section.

  1. 2.RIGHT OF WITHDRAWAL 

You have the right to withdraw from the order placed, without giving any reason, within 14 days from the day you received the product ordered or the service purchased. In case of multiple purchases with the same order said period will start from the day of arrival of the last product. The exercise of the right of withdrawal may be communicated to us at the e-mail address [email protected] or by using the "contact us" option or, again, by submitting the form in Annex I, part B, of the Consumer Code. For the exercise of the right of withdrawal to be effective, the relevant notice must be sent to us before the expiration of the 14-day period. 

Once the right of withdrawal has been exercised, Vision S.r.l. will refund all purchase costs incurred by users related to the products and/or services purchased and for which they have decided to exercise withdrawal, always in compliance with the 14 days. Said reimbursement and withdrawal will be made within 14 days of receipt of the notice of withdrawal and will not entail any cost to the user who has decided to exercise it other than those related to shipping for redelivery. The refund will be made using the same payment method you requested to place your purchase order. We may suspend the refund until we have received the product or until you have provided proof of return to Vision S.r.l, whichever comes first. Products must be returned within 14 days from the day you gave notice of withdrawal. You will have to bear the direct costs of returning the products. You may be held liable for any diminution in the value of the goods resulting from the handling of the goods (other than that necessary to establish the nature, characteristics and operation). 

  1. 3.EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right of withdrawal does not apply in the cases of:

  1. 1.Supply of sealed goods that are not suitable for return for hygienic or health protection-related reasons and that have been opened after delivery or in case of supply of products that are, after delivery, inseparably mixed with other goods;
  2. 2.Supply of custom-made or clearly customized goods;
  3. 3.Supply of goods that are likely to deteriorate or expire quickly;
  1. 4.PRICES AND PRODUCT AVAILABILITY

Information regarding the prices or availability of the products we offer is listed and available on the "acquadipanarea.com" website, as well as on the reference page of each product. Shipping and delivery times, which will be communicated to you, will be purely indicative and are, therefore, not guaranteed. If the products and/or services you have purchased are not available you will receive an e-mail notice of product unavailability to the address corresponding to your profile. If, due to misunderstandings or other mishaps or clerical errors, the price listed on the site is less than the correct sale price of a product and/or service, we may contact you to verify whether you still wish to purchase the product at the correct price or we may not accept your order. If the correct price of a product is less than the price listed on the site, we will charge you only the lower correct price and still ship the product to you.

  1. 5.WARRANTY ON PRODUCTS AND SERVICES OFFERED

The warranty regime on products sold by Vision S.r.l. differs depending on whether the buyer is a "consumer" or a "professional" within the meaning of Directive 1999/44/EC. If you buy as a "consumer," you will be entitled to the legal warranty of conformity to which the seller is legally bound on every good sold ("Legal Warranty"). Said warranty guarantees the good against defects of conformity with the contract of sale. In cases where the Legal Warranty is applicable, you will have the right to restoration of the conformity of the good without cost by repair or replacement, or, if this is not possible, to a reduction of the purchase price or termination of the contract. Vision S.r.l. is, therefore, liable for defects of conformity when they have become apparent within two years from the date of delivery of the goods. You will still have the burden of reporting the conformity defect within the term of two (2) months from its discovery. In the event that you find a lack of conformity on the goods purchased, during the period of validity of the Legal Warranty, please contact us through the "contact us" function. To the extent permitted by law, Vision S.r.l. disclaims any responsibility for the case in which the delivered goods do not comply with the legislation of the country of delivery other than Italy.
